Terms of Reservation / Rules & RegulationsDefinitions
1.The Online Accommodation Booking System (hereinafter referred to as System), enables reservation of accommodation offered by RECEPTION.PL. 2.Customer - physical or legal person with full legal capacities under the Civil Code, or another person without legal personality that can be, under separate laws, subject of rights and obligations, who utilizes the System in order to make reservation of RECEPTION.PL services. 3.The System Operator, and the domain owner is „RECEPTION.PL” s.c. with its registered seat at: ul. Krakusa 10/12 30-535 Kraków. 4.Payment Verifier – an authorized verifier of E-card payments, authorizing and settling all payments in the System by means of an encoded 128 bit protocol. 5.The Form – a standardized electronic document constituting a form for registration, reservation, or cancellation of reservation of a RECEPTION.PL service available within the System. 6.Available Reservation - reservations made in real time (online) within a pool of vacancies offered by the System. 7.Reservation upon Request - reservations made offline when the System offers no vacancies and reservation requires a direct contact with the RECEPTION.PL service provider. Reservation, confirmation, information on hotel reservations
1.Reservations within the System are made by filling-in and submitting the reservation form for a given service.2.Customer shall assume full liability for consequences of entry of incorrect data in the reservation form. 3.In case of Available Reservations, following the receipt of confirmation of payment from Payment Verifier, the System automatically sends a confirmation of reservation to the e-mail address indicated in the reservation form by Customer. 4.In case of Reservations upon Request, following the receipt of confirmation of payment from Payment Verifier, the System automatically sends a confirmation of reservation to the e-mail address indicated in the reservation form by Customer. The confirmation of ordered services or information on unavailability of vacancies on the indicated date is sent to Customer by System Operator within 24 hours from the placement of a reservation, or on the first working day after the booking. 5.Along with the confirmation of the reservation of ordered services, to the indicated e-mail address, Customer shall receive a Voucher constituting the proof of conclusion of the contract and the basis for the use of ordered services. 6.A change, or a cancellation of the reservation is possible by sending an e-mail containing the information on the reservation made to the e-mail address which the reservation was sent from. The email shall contain the information on the change, or the cancellation of the reservation. 7.The requests entered in the reservation form in the Special requirements field (e.g. a request for a non-smoking room, adjacent rooms, separate beds, a child bed) shall be sent to service providers as non-binding information. Meeting those requirements may not be guaranteed. 8.Standard conditions of cancellation and change of reservation shall not apply to some service reservations. The relevant information shall be found on the Object’s sub-site. Form and terms of payment
1.Payments shall be made by means of a valid credit card or an electronic bank transfer. All required information must be submitted in the form.2.The completion of a reservation, irrespective of the type of reservation of services, shall depend on a full payment for reserved services. 3.The authorization and settlement of payment shall be carried out by means of on the System terminal through direct connection with Payment Verifier by means of a secured and encoded protocol. 4.The amount payable shall be blocked on the credit card and collected on the day following the submission to Customer of the confirmation of reservation. In case of a payment by bank transfer, Customer’s account shall be charged immediately upon the completion of authorization. 5.The System shall refuse reservation in case of: a.negative verification of the credit card by Payment Verifier, b.inability to block the amount payable on the credit card, c.lack of adequate means in Customer’s bank account. 6.The payment tender shall be Polish złoty (PLN). Prices in EUR, USD, are quoted exclusively for presentation purposes, and shall be converted according to the System’s current exchange rate. Any differences in payment may result from discrepancies of the exchange rate of transaction carried out by Customer’s credit card processing centre or by Customer’s bank. 7.Upon Customer’s request, following the performance of reserved services, System Operator shall send a VAT invoice issued in accordance with Polish tax regulations. 8.Payment for other services and related services purchased by Customer outside of the System must be made to providers of such services by Customer himself. 9.The price of accommodation includes the VAT. The price of accommodation doe not include the climate fee, and Customer shall pay it himself. Change of reservation
1.A change of reservation must be made by e-mail, or by contacting RECEPTION.PL by phone.2.A change of reserved services directly with the service provider shall not be effective for settlements and reservations made in the System. 3.All changes of reservations of RECEPTION.PL services shall depend on viability of every change. 4.A change of Customer’s data shall be free of charge. 5.A change consisting in the reservation of additional services (in case of hotel reservations –increase of number of rooms or nights, trips, and guided tours – number of guests, transfers – number of cars) on top of the previously confirmed reservation shall not be subject to any additional charges. 6.Any other changes or modifications (consisting in decrease of number of guests or shortening of the period of stay, change of the reserved date, change of the hotel) of RECEPTION.PL services reservation shall be treated as a cancellation of the previous reservation and subject to the following charges: a.free of charge in case of a change of reservation within 24 hours prior to the date of stay, or the date of commencement of execution of another service b.100% of value of the first unused night in case of a hotel reservation, if the reservation was changed less than 24 hours prior to the date of stay. 7.In order to make changes of the reservation, Customer sends RECEPTION.PL a filled-in return form. 8.Modified reservation of services shall be a new reservation in the System and subject to procedures provided for in the Regulations. The amount paid for the cancelled reservation decreased by any cancellation-related charges shall be calculated towards payment for new reservation. Customer shall be under obligation to cover any unpaid portion of the amount due, or the System shall return a portion of the paid amount, if the value of the new reservation is lower than the previously paid amount decreased by cancellation fee. Cancellation of reservation
1.Cancellation of reservation must be made by a return form, or by phone.2.Cancellation of reserved services directly with the service provider shall not be effective for settlements and reservations made in the System. 3.Standard terms of cancellation: a.free of charge in case of cancellation up to 24 hours prior to the date of stay (from check-in hour) or the date of commencement of execution of another service b.100% of value of the first unused day in case the reservation is cancelled less than 24 hours prior to the date of stay c.100% of value of reserved services in the event of Customer's failure to appear or use reserved service within specified deadline, without prior cancellation. 4.Standard terms of cancellation shall not apply to some reservations of services. 5.In case of a cancellation of reserved services, the amount paid for that reservation shall be returned by a bank transfer into the account indicated by Customer or by crediting the credit card following deduction of cancellation fees. Scope of operator’s liability
1.The System Operator shall not be liable for lack of access to the System due to reasons independent of the Operator.2.The System Operator shall have the right to temporarily suspend access to the System for a period of time necessary in order to remove existing threats or failures. 3.The System Operator undertakes to take every effort in order to provide a service of a similar standard and within the deadline specified in the form, if providing the reserved service is impossible due to reasons for which the System Operator is responsible. 4.The System Operator may offer to provide a service of a similar standard and within the deadline specified in the form, if providing the reserved service is impossible due to reasons for which the System Operator is not responsible. 5.If Customer does not consent to the execution of a service of a similar standard, the System Operator shall be under the obligation to return the amount paid by Customer for the service. 6.The System Operator shall not be liable for failure to execute or for delay in execution of obligations resulting directly, or indirectly from an act of Force Majeure. Force Majeure shall be a sudden, future event that could not be foreseen on the day of conclusion of the Contract and that was out of the Parties’ control. Personal data
1.The System Operator declares that for the purposes of proper execution of its obligations the following personal data of Customers are collected in the computer data base of the System: 1. Full name, 2. Electronic mail address, 3. Address of residence or mailing address, 4. Telephone number.2.Administrator of personal data shall be the System Operator. Pursuant to the act on protection of personal data, personal data shall be stored and processed by the System Operator with use of proper security measures, complying with Polish regulations. 3.By making reservation on the System website, Customers grant their consent to entry of their personal data in the data base of the System Operator and to transfer of data in aid of parties providing tourist service. Personal data shall be processed only for the purpose of execution of reservation, facilitation of following reservations, and marketing, in accordance with provisions of the act of August 29th 1997 on protection of personal data. Acceptance of conditions of reservation
1.The present terms of reservation shall apply to all reservations made within the System.2.Customer hereby accepts terms of reservation on behalf of all persons travelling with Customer. 3.Marking "I accept terms of reservation" field in the reservation form shall mean that Customer understands and accepts the Rules & Regulations. 4.If Customer does not accept the Rules & Regulations, Customer shall not be able to make reservation. 5.The System Operator shall have the right to change the present Rules & Regulations at any moment. The conditions in force on the date on which the reservation was made shall apply to confirmed reservations. |
